Missouri Drug Trafficking Charges: First-Degree vs. Second-Degree

Missouri separates drug trafficking into two distinct offenses under Chapter 579. Which charge applies matters immediately, because the felony class and sentencing range differ significantly between them.

First-degree drug trafficking under RSMo 579.065 covers knowingly distributing, delivering, manufacturing, or producing controlled substances above Missouri’s highest statutory quantity thresholds. At its baseline, it is a Class B felony. Higher quantities elevate it to a Class A felony. Second-degree drug trafficking under RSMo 579.068 applies when a person knowingly possesses, controls, purchases, or brings into Missouri controlled substances above lower statutory thresholds. It starts as a Class C felony and escalates to Class B or Class A depending on quantity.

Felony class sentencing ranges:

  • Class A felony: 10 to 30 years or life imprisonment
  • Class B felony: 5 to 15 years
  • Class C felony: 3 to 10 years

Most trafficking convictions require serving at least 85 percent of the sentence before parole eligibility. Some first-degree convictions carry no parole option at all. Critically, prosecutors don’t need to prove an actual sale occurred. Quantity alone is enough to trigger a trafficking charge, regardless of what the accused intended to do with the substance.

Each controlled substance carries its own gram-weight threshold. Heroin, cocaine, methamphetamine, fentanyl, and marijuana all trigger trafficking charges at different quantities. While Missouri legalized recreational marijuana possession for adults 21 and older under Amendment 3 (2022), the trafficking statutes were not changed. Possessing quantities above the statutory thresholds can still constitute trafficking regardless of the substance’s legal status for personal use. Aggravating factors, including trafficking near schools, parks, or public housing, or involving a minor, can increase the felony classification further. Asset forfeiture allows law enforcement to seize property connected to the alleged trafficking activity while the case is still pending.
